Terms of Service

1. Acceptance of Terms

By accessing or using Gradescale and any of its associated services, features, or content (collectively, "the Service"), you agree to be legally bound by these Terms of Service ("Terms"). Please read them carefully before using the Service. If you do not agree to these Terms in their entirety, you must not access or use the Service. Your continued use of the Service following any update to these Terms constitutes your acceptance of the revised Terms. These Terms constitute a binding legal agreement between you and Gradescale.

During account creation, you will be asked to explicitly accept these Terms of Service, our Privacy Policy, and our Health & Fitness Disclaimer. Your acceptance is recorded with a timestamp, your IP address, and user agent for legal compliance purposes.

2. Service Description

Gradescale is a training analytics platform designed for endurance athletes and their coaches. The Service allows users to import athletic activity data from connected platforms such as Strava, and provides tools including but not limited to:

  • Power Duration Curve (PDC) modeling — individualized performance modeling across the full range of effort durations, from seconds to hours.
  • Training load analytics — quantitative tracking of short-term and long-term training stress, form, and fitness trajectory over time.
  • Workout analysis — detailed post-activity breakdowns including power distribution, heart rate analysis, zone time, pacing quality, and automated insight generation.
  • Physiological estimates — model-derived approximations of functional threshold power (FTP), aerobic capacity (VO2max estimate), anaerobic work capacity, and daily readiness scores.
  • Coaching tools — athlete roster management, workout planning, compliance tracking, and performance summaries for coaches managing multiple athletes.
  • Training calendar & workout builder — plan workouts, track compliance, and manage training phases with an integrated annual planner.
  • Multi-sport support — sport-specific analytics for cycling, running, swimming, and hiking with dedicated thresholds and zone models.

The Service is intended to support training decision-making and performance awareness. It is not a medical service. Gradescale reserves the right to add, modify, or remove features at any time.

3. Eligibility

To use the Service, you must meet all of the following eligibility requirements:

  • You must be at least 18 years of age. If you are under 18, you may not use the Service.
  • You must have the legal capacity to enter into a binding agreement under the laws of your jurisdiction.
  • You must not be prohibited from receiving services under applicable laws (including export control or sanctions laws).
  • If you are registering on behalf of an organisation or team, you represent that you have the authority to bind that entity to these Terms.

By using the Service, you represent and warrant that you meet all eligibility requirements. Gradescale reserves the right to verify eligibility and to refuse or terminate access for any user who does not meet these requirements.

4. Account & Access

Access to the Service requires a valid Strava account, which is used for authentication and activity data import. By connecting your Strava account, you authorise Gradescale to access your Strava profile and activity data in accordance with the permissions you grant during the OAuth authorisation flow.

You are solely responsible for:

  • Maintaining the confidentiality and security of your account credentials.
  • All activity that occurs under your account, whether or not authorised by you.
  • Promptly notifying us of any unauthorised access or suspected security breach.

Gradescale reserves the right to suspend or permanently terminate your account, without prior notice, if we determine at our sole discretion that you have violated these Terms, engaged in fraudulent activity, abused the Service, or acted in a manner harmful to other users or to Gradescale.

5. Subscription & Billing

Gradescale offers the following subscription tiers:

  • Free tier — core features available at no charge, subject to usage limits described in-app.
  • Basic tier — daily-check-in surfaces and core load tracking at $5.99 USD per month (or equivalent in your local currency where applicable).
  • Premium tier — full analytics and modelling suite at $9.99 USD per month.
  • Coach tier — multi-athlete coach view at $19.99 USD per month, including up to 5 athletes; $4.99 USD per month per additional athlete above the first 5.

All paid tiers are also available on an annual billing cycle at a discounted rate; the annual price is shown in the checkout flow. Annual subscriptions are non-refundable for unused time after cancellation, but access continues until the end of the paid period.

All payments are processed securely by Stripe, Inc. Gradescale does not store your full payment card details. By subscribing to a paid tier, you authorise recurring charges to your payment method on the billing cycle you select.

You may cancel your paid subscription at any time from your account settings. Upon cancellation, your paid access will continue until the end of the current paid billing period, after which your account will revert to the Free tier. No refunds are provided for partial billing periods (monthly or annual).

Gradescale reserves the right to change subscription pricing. Any price change will be communicated with at least 30 days' advance notice via email or in-app notification. Your continued subscription after the effective date of a price change constitutes your acceptance of the new price.

6. Free Trial

New users may be eligible for a 30-day free trial of the Premium tier. No credit card or payment information is required to start the free trial. The free trial provides full access to all Premium features during the trial period.

At the end of the 30-day trial period, your account will automatically revert to the Free tier unless you choose to subscribe to a paid tier by providing payment information. Gradescale reserves the right to modify or discontinue the free trial offer at any time. Free trials are limited to one per user and may not be combined with other promotions.

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you acknowledge that you have read and understood the Privacy Policy.

You retain full ownership of your athletic data. Gradescale processes your data solely to provide and improve the Service. We do not sell your personal data to third parties. You may delete all of your data from the Service at any time using the account deletion tools provided in your settings. Upon deletion, your data will be removed from our systems in accordance with the timelines described in the Privacy Policy.

By using the Service, you grant Gradescale a limited, non-exclusive, royalty-free licence to process, store, and analyse your data solely for the purpose of providing the Service to you. This licence terminates when you delete your account and all associated data.

8. Intellectual Property

The Service and all of its components — including but not limited to software, source code, algorithms, analytical models, user interface designs, visual elements, documentation, trademarks, logos, and brand identity — are the exclusive intellectual property of Gradescale and its licensors, protected by copyright, trademark, trade secret, and other applicable laws.

You retain ownership of your own athletic data. Gradescale claims no ownership over the activity data, training records, or personal information you upload or import into the Service.

Nothing in these Terms transfers any intellectual property rights from Gradescale to you. You are granted a limited, revocable, non-exclusive, non-transferable licence to access and use the Service for your personal, non-commercial purposes in accordance with these Terms. Any reproduction, distribution, modification, or commercial exploitation of Service content without prior written consent from Gradescale is strictly prohibited.

9. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. The following activities are expressly prohibited:

  • Scraping or data harvesting — using automated tools, bots, spiders, or scrapers to collect data from the Service without prior written authorisation.
  • Reverse engineering — attempting to decompile, disassemble, reverse engineer, or otherwise derive the source code, algorithms, or underlying logic of the Service.
  • Automated access — accessing the Service through automated means in a manner that exceeds reasonable personal use or that places undue burden on our infrastructure.
  • Reselling or sublicensing — reselling, sublicensing, or otherwise commercialising access to the Service or any data derived from it without authorisation.
  • Interference — taking any action that disrupts, degrades, or interferes with the normal functioning or security of the Service, including denial-of-service attacks.
  • Impersonation — impersonating any person or entity, or falsely representing your affiliation with any person or entity.
  • Malicious content — uploading or transmitting viruses, malware, ransomware, or any other malicious or harmful code or content.
  • Circumventing access controls — attempting to gain unauthorised access to any part of the Service, accounts belonging to others, or systems connected to the Service.
  • Violation of third-party rights — using the Service to infringe upon the intellectual property, privacy, or other rights of any third party.

Gradescale reserves the right to investigate suspected violations and to take appropriate action, including account suspension, termination, and referral to law enforcement authorities.

10. Third-Party Services

The Service integrates with third-party platforms and service providers, most notably:

Gradescale does not control these third-party platforms and is not responsible for their content, availability, accuracy, or data practices. Any downtime, data loss, or service disruption caused by third-party platforms is outside Gradescale's control and responsibility. We encourage you to review the terms and privacy policies of all third-party services you interact with through the Service.

11. Health & Fitness Disclaimer

Gradescale is not a medical service, and nothing in the Service constitutes medical advice, diagnosis, or treatment.

All analytics provided by the Service — including but not limited to functional threshold power estimates, aerobic capacity estimates (VO2max), readiness scores, training load calculations, physiological profile modeling, and workout classifications — are mathematical approximations derived from algorithmic models. These outputs are provided for informational and educational purposes only. They are not a substitute for the advice, guidance, or supervision of a qualified sports medicine physician, certified coach, exercise physiologist, or other licensed health professional.

You assume all risk associated with your training decisions, physical activity, and use of any information provided by the Service. Gradescale expressly disclaims all liability for any overtraining, injury, illness, adverse cardiovascular event, or other health outcome — whether foreseeable or not — arising from or related to your use of or reliance on the Service.

Before beginning or significantly altering any training programme, particularly one involving high-intensity efforts, you should consult a qualified healthcare professional, especially if you have any pre-existing medical conditions, risk factors for cardiovascular disease, or have been inactive for an extended period.

By using the Service, you expressly acknowledge and agree that:

  • Gradescale provides training analytics, not medical advice. All outputs are mathematical approximations.
  • You assume full responsibility for your training decisions and physical activity.
  • You will consult a qualified healthcare professional before acting on any information provided by the Service.
  • You release Gradescale from any and all claims arising from your use of the Service for training decisions.

12. Accuracy Disclaimer

All metrics, estimates, and outputs generated by the Service are approximations. The accuracy of computed values — including threshold power estimates, aerobic capacity estimates, load scores, readiness indices, and climb analytics — is inherently dependent on the quality, calibration, and completeness of the data provided by your sensors and connected devices, including power meters, heart rate monitors, GPS devices, and cycling computers.

Gradescale makes no guarantees or warranties — express or implied — regarding the precision, accuracy, completeness, or fitness for purpose of any computed metric or analytical output. Model outputs may differ from values produced by other analytical platforms due to differences in methodology, data sources, and algorithmic assumptions. You should use Gradescale's outputs as one input among many in your training decision-making, not as definitive ground truth.

13. Service Availability

Gradescale aims to maintain a high level of service availability, but we do not guarantee uninterrupted or error-free access to the Service at any time. The Service may be temporarily unavailable due to scheduled maintenance, unplanned outages, infrastructure failures, third-party service disruptions, or events beyond our reasonable control.

Gradescale reserves the right to modify, suspend, or discontinue any part of the Service — temporarily or permanently — with reasonable notice where practicable. We will endeavour to communicate planned maintenance windows and significant changes in advance. Gradescale shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

14. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permitted by applicable law, Gradescale and its officers, directors, employees, agents, and licensors expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

To the maximum extent permitted by law, Gradescale's total aggregate liability to you for all claims arising from or related to these Terms or your use of the Service shall not exceed the total amount you paid to Gradescale in the twelve (12) months immediately preceding the event giving rise to the claim, or €50 EUR (whichever is greater).

In no event shall Gradescale be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, personal injury, property damage, or service interruption — regardless of the theory of liability and even if Gradescale has been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, Gradescale's liability is limited to the greatest extent permitted by applicable law.

15. Indemnification

You agree to defend, indemnify, and hold harmless Gradescale, its affiliates, licensors, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of or access to the Service in violation of these Terms.
  • Your violation of any applicable law, regulation, or third-party right (including intellectual property rights, privacy rights, or contractual rights).
  • Any content or data you submit, upload, or transmit through the Service.
  • Your misrepresentation of any information provided in connection with the Service.

Gradescale reserves the right to assume exclusive control of the defence of any matter subject to indemnification by you, at your expense. You agree to cooperate fully with Gradescale in the defence of any such claim.

16. Governing Law & Jurisdiction

These Terms and any dispute, controversy, or claim arising out of or in connection with them — including their formation, validity, interpretation, performance, breach, or termination — shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law principles.

Any legal action or proceeding arising under these Terms shall be brought exclusively before the courts of Zurich, Switzerland, and you hereby consent to the personal jurisdiction and venue of such courts.

Notwithstanding the foregoing, if you are a consumer residing in the European Union, you retain the right to bring claims before the courts of your country of habitual residence, and to benefit from any mandatory consumer protection provisions that apply in your jurisdiction. Nothing in these Terms limits any rights you have under applicable EU consumer protection law.

17. Dispute Resolution

Before initiating formal legal proceedings, both parties agree to attempt to resolve any dispute in good faith through informal negotiation. To initiate this process, the party asserting the dispute must send written notice to the other party describing the nature of the dispute and the resolution sought.

The parties shall have 30 days from receipt of such notice to attempt to resolve the dispute informally. If the dispute is not resolved within that 30-day period (or such longer period as may be mutually agreed in writing), either party may then pursue resolution through the courts as described in Section 16.

This dispute resolution procedure does not limit either party's right to seek urgent injunctive or other equitable relief from a court of competent jurisdiction where necessary to prevent immediate harm.

18. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, void, or unenforceable for any reason, that provision shall be deemed severed from these Terms and shall not affect the validity or enforceability of the remaining provisions. The severed provision shall be replaced by a valid provision that most closely approximates the intent and economic effect of the original provision.

19. Entire Agreement

These Terms of Service, together with the Privacy Policy and any other policies or notices expressly incorporated herein by reference, constitute the entire agreement between you and Gradescale with respect to your use of the Service. They supersede and replace all prior or contemporaneous agreements, representations, warranties, and understandings — whether written or oral — relating to the subject matter herein.

No waiver by Gradescale of any provision of these Terms, or of any breach thereof, shall be effective unless made in writing and signed by an authorised representative of Gradescale. No failure or delay by Gradescale in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy.

20. Trademark Notice

"Gradescale" and the Gradescale logo are trademarks of Gradescale. All other trademarks, service marks, product names, and company names or logos mentioned or displayed within the Service are the property of their respective owners.

Gradescale is an independent product and is not affiliated with, endorsed by, or sponsored by Strava Inc., TrainingPeaks LLC, or Peaksware LLC. Strava is a registered trademark of Strava Inc. TrainingPeaks is a registered trademark of Peaksware LLC. The use of these names within these Terms is solely for identification and informational purposes, and does not imply any relationship or affiliation.

21. Force Majeure

Gradescale shall not be liable for any failure or delay in the performance of its obligations under these Terms if such failure or delay is caused by events or circumstances beyond Gradescale's reasonable control, including but not limited to: acts of God, natural disasters, fire, flood, earthquake, epidemic or pandemic, acts of war or terrorism, civil unrest, government actions or regulations, strikes or industrial action, widespread internet or infrastructure outages, or failures of third-party service providers.

In the event of a force majeure occurrence, Gradescale will notify affected users as soon as reasonably practicable and will use commercially reasonable efforts to resume normal service operations as quickly as possible.

22. Changes to Terms

Gradescale reserves the right to update or modify these Terms at any time. When we make material changes to these Terms, we will provide at least 30 days' advance notice before the changes take effect, delivered via email to the address associated with your account and/or via a prominent in-app notification.

The updated Terms will be posted at this URL with a revised "Version" and "Last updated" date. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue your use of the Service before the effective date of the changes.

For non-material changes (such as corrections, clarifications, or updates that do not adversely affect your rights), we may update these Terms without advance notice, though the version number and date will always be updated.
