Health Data Processing Consent

Some information processed by Gradescale can reveal information about your physical condition and well-being. Gradescale relies on your explicit consent to process this information as health data.

For users in the European Economic Area, we rely on explicit consent under Article 9(2)(a) of the GDPR. For users in the United Kingdom, we rely on explicit consent under Article 9(2)(a) of the UK GDPR. For users in Switzerland, we rely on your express consent where required under the Federal Act on Data Protection.

1. Health Data Covered by This Consent

With your consent, Gradescale processes:

  • Heart-rate data and other exercise measurements that can reveal information about your physical condition.
  • Detailed recordings associated with your training activities where they are used to evaluate your physical condition or performance.
  • Sleep, stress, soreness, and other well-being check-ins that you choose to submit.
  • Training-load metrics, readiness scores, physiological models, performance estimates, and other health-related metrics derived from this information.

Subjective check-ins are optional. You can use Gradescale's core training analytics without submitting sleep, stress, soreness, or similar check-ins, although some readiness features may be unavailable or less complete.

2. Your Explicit Consent

I explicitly consent to Gradescale processing my heart-rate data, health-related exercise measurements, optional well-being check-ins, and the physiological and readiness metrics derived from them to provide training analytics and readiness features.

3. Why This Processing Is Needed

Gradescale's core service analyses training measurements and produces individual training and physiological outputs. Gradescale cannot provide these core analytics without processing the health-related information described above.

Giving consent is voluntary. You do not have to consent, but Gradescale cannot provide its core analytics service without this processing.

This consent does not cover optional product analytics, newsletters, marketing, advertising, research, training external models, or sharing your health data with a coach. Where consent is required for one of those purposes, Gradescale asks for it separately.

4. Withdrawing Your Consent

You can withdraw your consent at any time through Settings > Health data consent.

Withdrawal takes effect immediately. Gradescale will:

  • Stop importing and analysing your training and health data.
  • Revoke Gradescale's access to connected training providers.
  • End access to the Gradescale service and terminate any coach access.
  • Begin deleting your health and training data from active systems.

Withdrawal cannot be cancelled. The 30-day grace period available for ordinary account deletion does not apply when you withdraw health-data consent.

Your data will be deleted from active systems within 7 days. Residual copies in operational backups will expire within 30 days and will not be restored to active processing. Where a processor holds health data covered by this consent, we instruct it to delete that data as part of the same process.

Withdrawal does not affect the lawfulness of processing carried out while your consent was valid.

Gradescale retains a minimal record showing:

  • The consent wording and version presented to you.
  • When and how you gave consent.
  • When you withdrew consent.
  • When the associated deletion process was completed.

This record is retained only to demonstrate compliance and handle legal claims. It is kept for 10 years and does not contain your training or health measurements.

5. Declining Consent

You may decline consent during signup.

Existing users who are asked to provide this consent can select Decline and delete my data. Until you make a choice, Gradescale suspends new imports, health-data analysis, recommendations, and coach access. If you make no choice within 90 days, we dispose of the account through our ordinary 30-day cancellable deletion process and tell you by email before it completes, as described in the Privacy Policy.

Declining consent stops the service and starts deletion of the health and training data held for your account. You do not need to send an email to decline or withdraw consent.
